1. General terms

Source Naturelle operates an online shop at the internet address www.sourcenaturelle.eu henceforth called “the website”. All orders placed by you via the website as well as our products and services offered are governed exclusively by the Terms of Use conditions and notices set out below.

Access to and use of this Website and the products available through this Website are also subject to the following Terms & conditions. By using our services, you are agreeing to all of the Terms & Conditions, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made. Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Web site is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

2. Privacy policy

Our privacy policy, which sets out how we will use your information, can be found at this website. By using this Web site, you consent to the processing described therein and warrant that all data provided by you is accurate.

3. Prohibitions or limitations:

You will not use this website or make an online order or use the goods if you are aged under 18 years or if you are going to resell the products you are purchasing.

4. Terms of sale

By placing an order, you are placing a binding offer to purchase a product on and subject to the following terms and conditions. You submit an offer by entering all required information during the ordering process and posting the order form to us by clicking the “purchase” button. All orders are subject to acceptance by Source Naturelle, confirmation of the order price and availability of the product. Until such acceptance, items in your shopping basket are not reserved and may be purchased by other customers. You will receive an e-mail confirming receipt of your order and stating the details of your order (order confirmation). Please note that our order confirmation serves for information purposes only. A purchase contract between you and Source Naturelle will become effective only after we have accepted the offer by dispatching the goods ordered. Source Naturelle has the right to refuse any offer without stating a reason, especially if there are legitimate grounds to suspect that the goods purchased via the internet are intended to be resold on a commercial basis. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the products. All prices advertised are subject to changes without notice.

5. Pricing and availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled.

All prices are exclusive of VAT according to § 6 Abs. 1 Z 27 UStG for Small Business.

Delivery costs may be charged in addition; such additional charges are clearly displayed where applicable and included in the “Total Amount”. The company reserves the right to alter prices at any time prior to delivery.

6. Delivery

Delivery of the Goods shall be made by the Source Naturelle (our partner post.at )delivering the Goods to the place as specified in your order. Source Naturelle does not warrant that any products purchased by you comply with all statutory requirements and regulations relating to the sale of the Goods in other jurisdiction (not in Austria) and it is your sole responsibility to ensure compliance. Source Naturelle has no liability if you fail to take delivery of the Goods or any part of them on the Delivery Date and/or fail to provide any instructions, documents, licenses, consents or authorisations required to enable the Goods to be delivered on that date.

7. Damage/Loss in Transit.

Source Naturelle accepts no liability for any loss resulting from your failure to comply with our carrier’s requirements with respect to notification of damage, shortage or non-delivery of Goods.Goods should be inspected on receipt and damage/shortages advised in writing to the carriers and ourselves within 4 days.

Damaged Goods and original packaging must be retained for inspection at the company’s discretion. Damaged Goods returned to the company will only be accepted if previously agreed in writing. Non delivery must be advised in writing to the carriers and ourselves within 10 days of date of order.

8. Returns & Refunds Policy

If you return goods to us, unopened, within 14 days of the day of delivery we will refund the amount charged. We do advise you obtain proof of posting from your local post office. We regret that no refunds will be given on products already opened. See our Cancellation Policy below for more details.

This Returns Policy does not affect your legal rights.

9. Cancellation Policy

If you wish to cancel your order, you have the right to cancel the contract for the purchase of the item(s) within a period of 14 days (commencing from the date the goods are received). This applies to all of our products. However we regret that we cannot accept cancellations for purchases where the item(s) has been opened. To cancel an order, written confirmation to email contact@sourcenaturelle.eu must be made within this 14 day period.  Goods must then be returned unopened within 14 days of the delivery date to receive a full refund for your order. All returned orders should be sent to the following address:

For your protection, we recommend that you use a recorded-delivery service and obtain proof of posting from your local post office. You must ensure they are packaged adequately to protect against damage. Please note that you will be responsible for the costs of returning the goods to us. As soon as we receive the returned unopened item(s), we will refund the relevant purchase price.

10. Limitation of Liability

Our liability to you for breaking any of these conditions is limited to refunding any money you have already paid for items that you have not received or that you have returned within the agreed time scales and in the required condition. We won’t be liable for any other loss or damages, unless the loss or damages are caused by our negligence or our breach of these terms and conditions.

We do not accept liability for any errors and omissions and reserve the right to change information, prices, offers, specifications and descriptions. We will endeavour to do our best to correct errors and omissions as soon as practicable after we become aware of them. We shall be under no obligation to dispatch an order for products/offers which have been advertised incorrectly but we shall give you the option to either cancel the order or confirm the order at the correct price.

11. Payment

Payment for the Goods and any applicable delivery charges can be made by any method shown on the Source Naturelle website at the time you place your order. Refunds will generally be made by the same means of a credit to your chosen method of payment. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle Source Naturelle to terminate the contract immediately.
There will be no delivery until cleared funds are received. If due to default in payment Source Naturelle incurs additional costs in collecting the debt such as legal or debt collection fees etc. then you will be held liable for all of these costs.

12. Other Terms:

Source Naturelle is not responsible for any side effects caused by using the products found on our website.

13. Disclaimer as to ownership of trademarks, images of personalities and third party copyright

Except where expressly stated to the contrary all persons (including their names and images), third party trademarks and images of third party products, services and/or locations featured on this Website are in no way associated, linked or affiliated with Source Naturelle and you should not rely on the existence of such a connection or affiliation. Any trade marks/names featured on this Website are owned by the respective trade mark owners. Where a trade mark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to Source Naturelle.

14. Links To Third Party Web Sites

From time to time this website may contain links to websites controlled by third parties. The Company provides these links merely as a convenience. Access to other web sites is at your own risk and the Company is not responsible for and does not endorse or accept any responsibility over the contents or use of these web sites.

15. Governing law and jurisdiction

These terms and conditions are to be construed in accordance with the laws of Austria and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Austria courts.

16. Entire Agreement

The above Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Source Naturelle. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by Source Naturelle Management.
